A dramatic courtroom decision brings relief and renewed debate after a former officer is acquitted in a case that blurred the lines between tragedy, mental health, and the justice system. Kelsey Fitzsimmons, a 29-year-old former North Andover police officer, was found not guilty of assault with a dangerous weapon following a tense and deeply emotional legal battle.
The case stemmed from a June 2025 incident when fellow officer Patrick Noonan arrived at Fitzsimmons’ home to serve a restraining order and custody terms involving her infant son. During the encounter, Fitzsimmons was shot, suffering a serious chest wound that required extensive medical treatment. Prosecutors alleged she had threatened Noonan with a firearm, while Fitzsimmons maintained that she had been in a state of crisis and intended to harm herself, not anyone else.
During the bench trial, Essex County Superior Court Judge Jeffrey Karp ruled that there was reasonable doubt as to whether Fitzsimmons ever pointed the weapon at Noonan. He concluded that the prosecution had not met the burden of proof required for a conviction.
